OKANOGAN COUNTY BOARD OF COMMISSIONERS

April 26, 2005

The Okanogan County Board of Commissioners met in regular session on April 26, 2005, with Chairman Mary Lou Peterson, Commissioner Andrew Lampe, Commissioner Don Hover and Brenda Crowell, Clerk of the Board present.

Discussion – HB1003 Off Road Vehicle Use – Gary Allard NC ATV Club
Gary Allard stated that the Engrossed House Bill 1003 was to allow the county and the Forest Service to open roads up to Off Road Vehicles (ORV). The group is requesting the roads be opened from Conconully to Loomis, specifically, Mineral Hill, North and West Fork, Loomis City Limits to Sinlahekin Road. This would make roads available for traveling from Loomis to Conconully. It was noted that the Fish & Wildlife signed off on the bill. DNR already allows for Off Road Vehicles. The Commissioners will discuss the issue with Pubic Works.

Discussion – Project Updates – Public Works
Rob McGaughey reported that the legislature appropriated $400,000 for the Construction of Toroda Creek Road. After closing on the purchase of Satiqua Park they will start acquiring right-of-way for the Sinlahekin trail. The Commissioners stressed that Dry Coulee Road have ditches and crowned so the water can run off.

Discussion – Crushing Contracts – Public Works
The Commissioners asked Rob McGaughey to design the specifications and timelines so that everyone has an opportunity to bid on the gravel crushing for road maintenance. The Commissioners told Rob to separate the contracts into 3 different solicitations and extend the timeframe 30 days. Commissioner Peterson stated that the solicitations were to have gone out in February. Rob explained that they were waiting on a permit from DOE.

Discussion – ORV Bill – Public Works
The Commissioners explained that the Off Road Vehicle bill passed and asked that Public Works begin the process for a pubic hearing to adopt an ordinance for the Off Road Vehicles.

Discussion – Juvenile Meals - Jail
Noah Stewart explained that the school meals have been audited and they are asking that the jail serve tacos and pizza etc. as a supplement to the Juvenile diet. In addition, Noah reported that Kevin Mallory is also taking a position outside but would be willing to stay on if the position was a fulltime. (attachments)

Motion – In-County Meals – Noxious Weed
Commissioner Lampe moved to approve in-county meals for the Aquatic Workshop. Motion was seconded and carried. (attached)

Motion – Subscription Agreement - Teamsters
Commissioner Hover moved to approve the Washington Teamsters Welfare trust for dental and vision Subscription Agreement. Motion was seconded and carried.

Change Order – In-County Courtroom-Stan Carter Construction - Facilities
Commissioner Lampe moved to accept change order #1 with Stan Carter Construction for the in-county courtroom. Motion was seconded and carried. (attached)

Discussion – Gravel Crushing Contract – Commissioners
Rob McGaughey, Rose Clements and Heidi Appel

The legal requirements for a sealed bid were discussed. Heidi Appel explained that the solicitation could not be split into 3 parts if it was for the purpose of using the small works roster to avoid the bidding process. The Commissioners explained that they have received complaints that solicitations do not provide the best opportunity for competition since DeAtley Crushing is the only bidder each year and gets the bid. The timeframe to provide the crushing is too short for the volume of material and thereby eliminates any local bidding opportunities. Only large businesses can provide material in such a short timeframe. Rob McGaughey explained that one pit would not be bid at all if the contract was split into three parts. They directed Rob McGaughey to make sure that next year and subsequent years to release the solicitation in late fall for needed material the following years needs.
