OKANOGAN COUNTY BOARD OF COMMISSIONERS

December 28, 2010

The Okanogan County Board of Commissioners met in regular session on December 28, 2010, with Chairman, Andrew Lampe, Commissioner Don Hover and Lanie Johns for Brenda Crowell, Clerk of the Board present. Commissioner Mary Lou Peterson not attending.

Discussion Juvenile
Nan Kallunki, Dennis Rabadou, & Sabrena Smith

Nan Kallunki, Dennis Rabadou, & Sabrena Smith discussed the department funding levels and staffing issues and made several suggestions to the commissioners.

Due to the budget situation, Juvenile administration non bargaining employees have agreed to take a 10% reduction in pay for 2011 in order to meet the lower budget allocation. This reduction doesn’t apply to Union employees.

Commissioner Lampe and Commissioner Hover both agreed that Nan should go ahead with the proposal to the Union.

Commissioner Lampe asked about the Capital Facilities Plan. Nan stated she said it was outdated and should have been done a year ago. Commissioner Lampe stated it is needed for the Finance Committee among other reasons. There have been no changes made to update it. Some of the requirements have been done, but Nan said there are roads and other items/plans that she has to research. She has to get with lots of dept to get their input. Nan said it has been on her to do list for a long time and should have been working on this. Commissioners asked her to make it a priority for 2011; it really needs to be updated.

Motion – Noxious Weed Manager Addendum to Employment Agreement – Anna Lyon
Commissioner Hover moved to approve the employment addendum to Anna Lyon’s employment contract. Motion was seconded and carried. (attached)

Motion – Resolution 454-2010 Budget Transfer Public Works #32
Commissioner Hover moved to approve resolution 454-2010 a budget transfer within the Public Works budget. Motion was seconded and carried.

Motion – Site Sharing Agreement with NCI Datacom Inc. (NCID)
Commissioner Hover moved to authorize the Site Sharing Agreement with NCID for over the air communications sited in Okanogan County. Motion was seconded and carried. (attached)

Motion – Commissioners Proceedings December 20th & December 21, 2010
Commissioner Hover moved to approve December 20th & December 21st, 2010 commissioner proceedings. Motion was seconded and carried.

Motion - Voucher Approval – Commissioners
Vouchers certified and audited by the Auditing Officer as required by RCW 42.24.080 and those expense reimbursement claims certified as required by RCW 42.24.090 have been recorded on a list and made available to the Board. As of this date, the Board did by unanimous vote to approve the Current Expense vouchers in the amount of $343,068.53. Warrant numbers are cited on the attached blanket voucher lists. (attached)

Update - Public Works
Bob Parten

Bob Parten updated the commissioners on snowplowing issues and concerns.

The board discussed the issues with plowing Bonaparte Lake Road. Commissioner Lampe stated it appears the portion of road in question is beyond the snow park and is not a county owned road.

Several landowners who use or live on the road came in to explain their recollection of the county’s ownership of the road.

Tom Haggeman, 743 A Bonaparte Lake Rd, Tonasket. Mr. Haggeman stated the road is part of the original land grants passed down by the Grants. There is a letter to Commissioner Peterson from Mark Morris dated 1/27/2005 that stated it appeared the County owns easements to the road. An Averill Patent gave the county right away of approx 30 ft for the road.

Commissioner Hover stated the county doesn’t own the portion of road they are asking to be plowed. There is liability in plowing it due to the width of the road and conditions of the trees making the road narrow. The second thing is whether the FS will accept the liability and whether an MOU can be done to lay out the terms. If we do own the road would it be considered a primitive public road and if it is the county doesn’t usually plow those roads.

Bob Parten stated the 1955 resolution adopting the county roads shows portions of the Bonaparte Lake Road but it is confusing and appears to have typos. He asked why the FS would spend money on improving the road last year if it were the County’s road.

Testimony was given that the county has plowed the road forever and has been used by the public. The county started plowing the road around 2000, although inconsistently.

Commissioner Hover stated the county may continue to plow as they have been until we discover whether there is liability in doing so further up and talk with FS about determining ownership of the road and perhaps approving an MOU. They have to look out for the county as a whole and protect the public to make sure the county is not at risk.

Patty Haggeman, thanked the commissioners for taking her call earlier and taking the time to listen and try to resolve the issues. They want to help work on this situation with the county, FS and the residents who live on the road.

Tonasket EMS
Commissioner Hover moved to adjourn as the Board of Commissioners and reconvene as the Tonasket EMS District. Motion was seconded and carried.

Motion – Professional Services Agreement – Steve Mattson
Commissioner Hover moved to approve the Personal Services Contract with Steve Mattson for the Tonasket EMS District. Motion was seconded and carried.

Commissioner Hover moved to adjourn as the Tonasket EMS District and Reconvene as the Board of Commissioners. Motion was seconded and carried.

Discussion – Homeless Housing & Affordable Housing Funds – Lael Duncan

Lael Duncan and Roger Baurer discussed with the board, the Professional Services agreement and the Homelessness Housing and Assistance agreement.

Lael stated Steve Bozarth has reviewed them both, but after conversing with Commissioner Lamp earlier, Lael said the documents may need to be tweaked. The commissioners did review the documents and noted the dates show the term as six years but the language says five years. There was also a question about what state auditor requirements need to be outlined in the agreement, specifically regarding the county needing to have backup for expenditures on the invoices.

Lael said the professional service agreement is a requirement of legislation.

Lael will make some changes and resubmit the documents.
